1. Formation of contract

With your order you make a binding offer to us to conclude a contract with you. We can accept this offer by sending an order confirmation via e-mail to you or by the delivery of the ordered goods. First, you will receive a confirmation that we recieved your order via e-mail to the specified e-mail address (order confirmation). However, a purchase contract is concluded only with the dispatch of our order confirmation via e-mail to you or with the delivery of the ordered goods.

When ordering through our online store the ordering process includes a total of two steps. In the first step, select the desired goods. In the second step, enter your customer data, including billing address, possibly deviating delivery address and choose how you want to pay. You finish by clicking on 'Order' and send your order to us. Then there is the opportunity to correct details about your order if necessary via email to info@marcelmokbel.com.

2. Storage of contract information

We store the treaty text of your order. We will send you an order confirmation with all order data and our Terms and Conditions to the email address specified by you.

3. Reservation of proprietary rigths

The delivered goods remain our property until full payment of all claims.

4. Withdrawal

You have the right to withdraw this contract within fourteen days without giving a reason. The withdrawal period is fourteen days from the date on which you have taken possession of final goods (or a representative from you, other than the carrier). To exercise your right of withdrawal, you have to declare to us:

by way of unambiguous statement (for example, a consigned by post mail, fax or e-mail) your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient that you send your communication concerning the right of withdrawal before the end of the withdrawal period.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments we have received from you, including the costs of supply (with the exception of the additional costs arising from the fact that you have chosen a type of delivery other than the cheapest Standard offered by us), and repay immediately, latest within fourteen days from the date on which the notification has been received about your cancellation of this contract with us. For this repayment, we use the same method of payment that you used in the original transaction, unless you explicitly agreed otherwise; in no case you will be charged fees for this repayment. We may withhold reimbursement until we have received the returned goods back, or until you have demonstrated that you have returned the goods, whichever is the earlier.
You have to return the goods immediately and in any event not later than fourteen days from the date on which you inform us of any cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days.
We bear the cost of returning the goods. You only need to pay for any diminished value of the goods, where the value loss is due to handling of the goods in a way not necessary to testing the quality, characteristics and functioning of the goods.

5. Prices, shipping costs, return costs upon withdrawal

All prices are final, they are free of VAT (in Germany) due to the german 'Kleinunternehmerregelung'. When shipped to other countries, it is possible that you have to pay VAT. Check the lays of your country.


6. delivery

Unless otherwise stated in the offer, we will ship the product within 2 business days after receipt of the payment or send digital media via email. For payment via PayPal we deliver the goods, unless otherwise stated in the offer, within 2 business days after delivery of the order confirmation.

7. payment

Payment is made either in advance by bank transfer or PayPal payment. We reserve the right to exclude individual payment methods. When selecting the advance bank transfer payment, we give you the bank details in the order confirmation. The total amount is to be transferred within 10 days to our account. A right of retention can only exercise if the claims result from the same contractual relationship.

8. warranty

The warranty is based on the statutory provisions. As far as used goods are subject to the transaction and the buyer is not a consumer, the warranty is excluded. If the customer is a consumer, the warranty period is the purchase of used items one year.

9. Data protection

At initiation, completion, execution and termination of a sales contract we collect, store and process data in accordance with legal provisions.

When you visit our website your currently used IP-address, PC date and time, the type of browser and operating system of your PC, and the pages you are visiting will be logged. But we do not intend to relate to personal data.

The personal data that you provide us (e.g. Yyur name and contact information) will be processed only for correspondence with you and only for the purpose for which you have provided us the data. We share your information only with the shipping company, to the extent necessary to deliver the goods. For the settlement of payments your payment details will be given to the agency responsible for paying.

We assure you that we will not pass your personal information to third parties, unless we are legally obligated or you have expressly consented. If we take on services of third parties (e.g. for implementation and management of manufacturing processes), the provisions of the german Data Protection Act are complied with.

Length of storage

Personal data which have been communicated to us through our website are only stored until the purpose, for which they were entrusted to us, is fulfilled. As far as trade and tax retention periods are observed, the duration of the storage of certain data may be up to 10 years.

Your rights

If you no longer agree with the storage of your personal data (or they have become incorrect), we will arrange the deletion, correction or blocking of your data to your instructions in the context of the statutory provisions. You can request free information about all personal information that we hold about you. 10. Applicable Law

Only German law is applicable. Compared to a consumer, this choice of law applies only in so far as it does not restrict any binding legal provisions of the country in which he has his domicile or habitual residence.
